Provision of funds is not deductible until effectively applied to housing expenses

A taxpayer inquired whether a provision of funds for the purchase of a primary residence could be deducted in 2012, even if the invoices were dated 2013. The Directorate General for Taxes (DGT) ruled that a provision of funds is only deductible when it is actually applied to the payment of the expenses.

The question raised

Whether the provision of funds may be subject to deduction in the tax return for the 2012 fiscal year even if the invoices are dated 2013, or whether they must be declared in the tax return corresponding to the 2013 fiscal year.

The DGT's ruling

Amounts provided as a provision of funds to meet home acquisition expenses are only deductible from the moment they are effectively applied to the payment thereof. They do not have a deductible character at the time of their delivery to a management agency or entity, nor when said entity submits its settlement.
