Six-month deadline to reinvest in life annuities extended due to state of alarm

A taxpayer over 65 has enquired about the extension of the deadline to establish a life annuity following the sale of a property due to COVID-19. The DGT clarifies that the deadline is suspended during the state of alarm and that the exemption is applied proportionally if the total amount is not reinvested.

The question raised

1. Extension of said period due to the declaration of the state of alarm.

The DGT's ruling

The calculation of the six-month period for reinvestment in a life annuity is suspended from March 14, 2020, until May 30, 2020. If the amount allocated to the life annuity is less than the total amount obtained from the transfer, only the proportional part of the capital gain corresponding to the reinvested amount shall be excluded from taxation.
