Non-profit associations must file Corporate Tax returns if they exceed certain income thresholds

A non-profit association has enquired whether it is required to file a Corporate Tax return as a partially exempt entity. The DGT has ruled that the association is a taxable person and must declare all its income, unless it meets specific income requirements.

The DGT's ruling

Las entidades sin ánimo de lucro pueden acogerse al régimen de entidades parcialmente exentas, donde estarán exentas las rentas de su objeto social y no lo estarán los rendimientos de explotaciones económicas. Están obligadas a declarar la totalidad de sus rentas, exentas y no exentas, a menos que sus ingresos totales no superen 100.000 euros, sus rentas no exentas sometidas a retención no superen 2.000 euros y todas sus rentas no exentas estén sometidas a retención.
