Requirements for the main residence investment tax deduction under the transitional regime

A taxpayer asks whether they can claim the main residence investment tax deduction for a property owned by their spouse but used as their residence. The Directorate General for Taxes (DGT) rules that they cannot access the transitional regime because they did not acquire ownership of the property before 2013.

The DGT's ruling

Para acceder al régimen transitorio de la deducción por inversión en vivienda habitual, el contribuyente debe haber adquirido la vivienda con anterioridad a 1 de enero de 2013. Además, es necesario que el contribuyente hubiera practicado la deducción por dichas cantidades en un periodo anterior a esa fecha. Para que una vivienda sea considerada habitual, el contribuyente debe adquirir su pleno dominio, aunque sea compartido, y residir en ella al menos tres años.
