Public entity exempt from corporate tax and no declaration required

A public entity established by an autonomous community law seeks clarification on its corporate tax exemption and obligation to file declarations. The DGT determines it qualifies as an autonomous body or entity of similar status, thus being exempt and exempt from filing declarations.

The question raised

Question posed: Whether the consulting entity would fall within the total exemption from Tax referred to in Article 9.1, and in that case, whether there exists any obligation to submit documentation for tax purposes or merely for declaratory purposes.

The DGT's ruling

Public law entities with legal personality, assets, and functional autonomy, created by law and for management or promotion purposes, hold the status of autonomous bodies or entities of an analogous nature. Therefore, they are fully exempt from Corporate Income Tax pursuant to Article 9.1 of the LIS. As exempt taxpayers, they are not required to file tax returns.
