Sale of a client portfolio generates capital gains or losses in the savings tax base

A professional carrying out an economic activity seeks advice on the tax treatment of selling their client portfolio prior to retirement. The DGT indicates that such a portfolio constitutes an asset tied to the business activity.

The question raised

Tax treatment in Personal Income Tax regarding the transfer to be carried out.

The DGT's ruling

The client portfolio is an asset element used for economic activity pursuant to Article 29.1 of the Personal Income Tax Law. Its transfer generates a capital gain or loss determined by the difference between the acquisition and transfer values. This result shall be included in the savings tax base.
