The taxable base for intracommunity acquisition of metals is the supplier's invoice amount

A precious metals company asks how to tax 'accounting purchases and sales' used for pricing. The DGT states that the taxable base for acquisition is the supplier's invoice amount and that settlement adjustments are not VAT-covered operations.

The question raised

Taxation of the operations carried out by the consulting entity for the purposes of Value Added Tax, and specifically, the operations referred to as the purchase and sale of accounting precious metals.

The DGT's ruling

The taxable base for the intra-Community acquisition of goods is the amount stated in the invoice issued by the supplier at the time of the physical purchase. Adjustments via settlement documents to determine the market price at the time of advance payment do not affect the taxable base, unless they are considered discounts or price modifications. The 'sale of accounting metals' operation does not constitute a taxable event nor remuneration. Advance payment does not trigger the accrual of the tax.
