Tax residence determined by stay duration, centre of vital interests and international treaties

A consultant enquires whether they retain tax residence in Spain while working in Belgium for more than 183 days, and if vehicle, housing, and subsistence expenses are deductible. The DGT explains how to determine residence under the Personal Income Tax Act and the treaty with Belgium, and sets out the requirements for asset allocation and the correlation of income and expenses for deductibility.

The DGT's ruling

La residencia fiscal se determina por la permanencia más de 183 días, el núcleo de actividades económicas o la residencia del cónyuge e hijos. En caso de conflicto con Bélgica, se aplicará el convenio para evitar la doble imposición. Para deducir gastos de un vehículo turismo, este debe ser elemento afecto exclusivo a la actividad. El alquiler de vivienda no es deducible si solo sirve de residencia personal, y los gastos de manutención deben producirse en hostelería y pagarse por medios electrónicos.
