EU officials with Spanish fiscal residence must file form 720

A staff member of the European Investment Bank asks whether she must file a foreign assets declaration. The DGT responds that EU officials maintaining fiscal residence in Spain are required to report foreign accounts and life/pension insurance up to certain thresholds.

The question raised

Question raised: Is the interested party obliged to submit the Form 720 informative declaration?

The DGT's ruling

European Union officials who establish their residence in another Member State due to their duties retain their tax residence in the State where they habitually resided. If they are tax residents in Spain, they must report foreign accounts if they exceed 50,000 euros. Foreign pension plans must be reported if they allow for redemption under terms similar to a life insurance policy, provided that the amount thresholds are exceeded.
