Wealth Tax exemption is a prerequisite for Inheritance and Gift Tax reductions

A query was raised regarding whether management functions required to obtain tax exemptions can be performed by a descendant rather than the shareholder. The Directorate-General for Taxes (DGT) ruled that both Wealth Tax exemptions and Inheritance and Gift Tax reductions are contingent upon meeting specific requirements regarding shareholding and management.

The question raised

Question posed: Whether the exercise of management functions, for the purposes of the exemption in Wealth Tax and subsequent reduction in Inheritance and Gift Tax, must be carried out by the holder of the shares or may be carried out by a descendant.
