Remuneration for operating funded accounts classified as income from economic activities

A taxpayer has requested clarification on how to tax payments received for conducting trades in accounts funded by third parties. The Directorate General for Taxes (DGT) has determined that, as these payments do not constitute employment income or capital gains, they are classified as income from economic activities.

The question raised

First Question: Tax classification of income obtained as remuneration from the funded account.

The DGT's ruling

The amounts received for operating simulated accounts are neither income from employment nor capital gains, as there is no employment relationship nor variation in personal assets. By operating with third-party resources and acting as a service provider through a commission contract, the activity is of a commercial nature. Therefore, the income is classified as income from economic activities and is included in the tax base as general income.
