End consumers of fluorinated gases are not taxpayers

An appliance repair company has enquired whether, as an end consumer, it is required to submit annual self-assessments for the Fluorinated Gases Tax. The Directorate General for Taxes (DGT) has ruled that it is not a taxpayer and has no self-assessment obligations, although it is required to provide information on invoices.

The DGT's ruling

Final consumers are not taxpayers of the Tax on Fluorinated Greenhouse Gases. Therefore, they are not required to register in the territorial registry, to maintain an inventory record, or to submit summary returns or self-assessments. However, they must state in their invoices the quantity of gas in kilograms, the corresponding heading, and the amount of tax incurred.
