Spouses may opt for joint tax returns with a non-common minor child or file individual returns

A taxpayer inquired whether she could file a joint tax return including a minor child from a previous marriage while her current husband files an individual return. The Directorate General of Taxes (DGT) ruled that the family unit comprises the spouses and the child; therefore, they must choose between all members filing jointly or all filing individually.

Cuestión planteada Si la consultante puede presentar declaración conjunta con su hijo menor, y su actual marido (que no es padre del niño) presentar declaración individual.

The DGT's ruling

La unidad familiar está integrada por los cónyuges y los hijos menores, independientemente de si el hijo es común o no. La opción por la tributación conjunta debe abarcar a la totalidad de los miembros de la unidad familiar. Por tanto, los cónyuges deben optar por la tributación conjunta incluyendo al hijo, o bien presentar ambos declaración individual.
