Minimum allowance for descendants applicable if child's income is below €8,000 and tax return is not filed for income exceeding €1,800

A taxpayer inquired whether they could claim the minimum allowance for a 24-year-old child with net income of €1,309.89. The DGT ruled that eligibility depends on whether the child exceeds specific income thresholds and their obligation to file a tax return.

The DGT's ruling

El contribuyente tiene derecho al mínimo por descendientes si convive con él y este no tiene rentas anuales (excluidas las exentas) superiores a 8.000 euros. Además, no podrá aplicarse el mínimo si el descendiente presenta declaración de IRPF con rentas superiores a 1.800 euros. Para la deducción por familia numerosa, el consultante debe cumplir los requisitos de actividad o prestaciones señalados en el artículo 81 bis de la LIRPF.
