Benefit-in-kind for vehicle renting is calculated based on the market value of a new vehicle

A query was raised regarding how to value benefits-in-kind when a company provides vehicles through renting for both professional and private use. The DGT clarifies that the calculation base is 20% of the market value of the vehicle as if it were new, maintaining this value throughout the duration of the contract.

The question raised

Valuation of the benefit-in-kind.

The DGT's ruling

When the vehicle is not owned by the payer, the benefit-in-kind for its use is 20% per annum of the market value that would correspond to the vehicle if it were new. This market value remains fixed according to the tax period in which the renting contract was entered into. The valuation includes insurance, taxes, and maintenance, but not fuel, which is considered an independent benefit if the company pays for it for private use. The benefit is imputed based on the mere availability of the vehicle for private purposes, not on its actual use.
