Public grants for textbook purchases are exempt from Income Tax under certain limits

A query was raised regarding whether municipal grants for the purchase of textbooks for compulsory education students are exempt from Personal Income Tax (IRPF). The Directorate General for Taxes (DGT) ruled that these grants are considered exempt public scholarships, provided they adhere to the principles of merit, capacity, generality, and non-discrimination.

The question raised

Whether such public aid granted for the acquisition of books is exempt from Personal Income Tax (IRPF).

The DGT's ruling

Public scholarships for formal studies, including aid for the acquisition of books and school supplies in free education levels, are exempt pursuant to Article 7.j) of the Personal Income Tax Law (LIRPF). For the exemption to be applicable, the grant must comply with the principles of merit and ability, generality, and non-discrimination. The exempt amount is limited by the amounts established in the Personal Income Tax Regulations.
