Spouse may retain main residence tax relief if the property remains their home

A query was raised regarding whether a spouse can continue to claim tax relief for investment in their main residence after annulling a legal separation and establishing the other spouse's home as the matrimonial residence. The Directorate General for Tax (DGT) ruled that the spouse may maintain the deduction in proportion to their ownership stake, provided the property remains their habitual residence.

The question raised

The DGT's ruling
