Investment in primary residence may be deducted until the date it ceases to be the primary residence

A taxpayer inquires whether they may continue to apply the deduction for investment in their primary residence after relocating their residence for professional reasons. The DGT responds that the deduction is applicable to the amounts paid while the dwelling maintains the status of primary residence.

The question raised

Question posed: Given the reason for the relocation, whether they could continue to claim for the residence in Badajoz. Alternatively, whether certain amounts paid in 2021, the year of the relocation, are eligible to be included in the deduction base in the tax return to be filed in 2022.

The DGT's ruling

The deduction for investment in the primary residence is applicable to the amounts paid during the tax year while the dwelling constitutes the primary residence of the taxpayer. Amounts paid after the date on which said primary residence status is lost shall not be deductible. The change of primary residence occurs on the date of the actual relocation to the new locality or when the previous dwelling ceases to be the primary residence. To apply the deduction, the assets at the end of the period must exceed the value at the beginning by the amount of the investments, excluding interest and expenses.
