Obligation to file Income Tax returns when employment and real estate income exceed €1,000

A taxpayer inquired whether they were required to file an Income Tax (IRPF) return due to receiving a retirement pension and imputed income from a homeowners' association. The Directorate General for Taxes (DGT) ruled that a return must be filed because the combined total of employment and real estate income exceeds the exemption threshold.

The DGT's ruling

Las comunidades de propietarios son entidades en régimen de atribución de rentas y no son contribuyentes del IRPF, sino que las rentas se atribuyen a sus miembros. El contribuyente está obligado a presentar la declaración cuando la suma de sus rendimientos íntegros del trabajo y del capital inmobiliario supera el límite conjunto de 1.000 euros anuales establecido en el artículo 96.2.c) de la LIRPF.
