Real estate income must be imputed for 50% ownership of a non-primary residence

A co-owner of an inherited property asks whether they must impute real estate income when their brother is the one residing in it. The DGT rules that they must impute income for their share of ownership.

The DGT's ruling

El titular de un inmueble urbano que no sea su vivienda habitual ni genere rendimientos del capital debe imputar una renta inmobiliaria. Esta renta se calcula aplicando el 2 por ciento al valor catastral, o el 1,1 por ciento si el valor ha sido revisado recientemente. En este caso, el consultante debe imputar la renta por su 50 por ciento de titularidad jurídica.
