Hygiene products for incontinence taxed at 21% VAT, unless they are pharmaceutical products under CN 30

A company has requested clarification on the VAT rate applicable to hygiene and skin care products for people with incontinence. The DGT has determined that these products are subject to the standard rate of 21%, as they are not included in the list of goods eligible for reduced rates.

The DGT's ruling

Los productos de higiene como manoplas húmedas, aceites, cremas, espumas, jabón líquido y toallitas húmedas tributan al 21% por no cumplir los requisitos del art. 91.Uno.1.6.º c) de la Ley 37/1992. No obstante, si los productos estuvieran clasificados en la Nomenclatura Combinada bajo la categoría 30 como productos farmacéuticos y cumplen los requisitos del apartado a) del mismo artículo, les correspondería el tipo reducido del 10%.
