Previous year's tax regime must be maintained if changes are not communicated in December

A taxpayer inquired whether they could switch to the objective estimation method for Personal Income Tax (IRPF) and the special VAT regime in 2021, following the cessation of an activity at the end of 2020. The Directorate General of Taxes (DGT) ruled that, since the modification was not submitted in December 2020, the same tax regimes must continue to apply throughout 2021.

Cuestión planteada Si, en abril de 2021, presentase la baja en la actividad de jardinería, podría en este año determinar el rendimiento neto de la actividad agrícola por el método de estimación objetiva y tributar en el IVA por el régimen especial de la agricultura, ganadería y pesca.

The DGT's ruling

Las modificaciones en el método de determinación de rendimiento neto en el IRPF y en el régimen de IVA deben presentarse mediante declaración censal en el mes de diciembre del año inmediato anterior al que deban producir sus efectos. Al no haberse presentado dicha modificación en diciembre de 2020, el contribuyente debe seguir aplicando durante todo el año 2021 los regímenes que aplicaba en el periodo impositivo 2020.
