Income tax withholdings may be deducted even if the employer has not remitted them to the Tax Agency

A taxpayer inquired whether they could reduce their personal income tax (IRPF) liability using withholdings from their payslips if the employer had neither declared nor remitted them. The Directorate General for Tax Regulations (DGT) ruled that they may be deducted, provided the taxpayer can prove they were indeed applied.

The DGT's ruling

El contribuyente debe integrar los rendimientos íntegros del trabajo exigibles y deducir la retención practicada, independientemente de que esta haya sido ingresada o no en la Hacienda Pública. La justificación de dichas retenciones deberá probarse por cualquier medio de prueba admitido en Derecho ante la Administración Tributaria.
