Deduction for investment in main residence may be maintained after divorce if it remains the habitual residence of children and the resident parent

The taxpayer asks whether they can continue to apply the deduction for investment in their main residence following a divorce where the minor child resides alternately with each parent. The DGT rules that this is possible under the transitional regime, provided the property remains the habitual residence for both the children and the parent with whom they reside.

The DGT's ruling

Bajo el régimen transitorio de la disposición transitoria decimoctava de la LIRPF, los contribuyentes que adquirieron su vivienda antes de 2013 pueden seguir aplicando la deducción. En supuestos de divorcio o separación judicial, el contribuyente podrá seguir practicando esta deducción por las cantidades satisfechas siempre que la vivienda continúe siendo la residencia habitual para los hijos comunes y para el progenitor con cuya compañía queden.
