Fecal occult blood diagnostic tests subject to 21% VAT as they are not for direct consumer use

A taxpayer queried the applicable tax rate for a fecal occult blood diagnostic test used for colon cancer prevention. The DGT ruled that the general rate of 21% must apply because the product is not suitable for direct use by the end consumer.

The DGT's ruling

Para aplicar el tipo reducido del 10% a productos de la categoría 30 de la Nomenclatura Combinada, estos deben ser susceptibles de uso directo por el consumidor final. Los productos de diagnóstico que se utilicen sobre una muestra del paciente no se consideran de uso directo. Por tanto, los tests de sangre oculta en heces tributan al tipo general del 21%.
