Sale of business stock held as collectibles is taxed as income from economic activities

A collector has enquired whether the sale of items remaining unsold following their retirement should be taxed as capital gains or as income from economic activities. The DGT has ruled that, as these items constitute stock from a commercial activity, the sale generates income from economic activities.

The question raised

As some items remained unsold, the inquiry concerns the classification of the income obtained from their sale through a third-party website that charges a commission for mediation services.

The DGT's ruling

The retail trade of collectible items constitutes an economic activity where the items are inventory. Therefore, their transfer generates income from economic activities and not capital gains or losses. The time elapsed between purchase and sale does not necessarily imply the cessation of the activity or the removal of the assets from the business.
