Competition prizes may be classified as employment income or business income depending on their connection

A university has requested clarification on the taxation of entrepreneurship competition prizes. The DGT has ruled that the classification depends on whether there is a link to an economic activity or if the participation is as a member of the university's own staff.

The question raised

Inquiry is made regarding the possible classification of prizes (with amounts ranging from 300 to 1,500) as income from employment for the purposes of Personal Income Tax (IRPF) taxation, and the applicable withholding tax.

The DGT's ruling

If the prizes are linked to the exercise of an economic activity, they shall be considered income from economic activities. If there is no link or if participation occurs as university staff, they shall be considered income from employment. The withholding tax will depend on this classification: if it is an economic activity, the provisions of Article 95 of the Regulation shall apply; if it is employment, Article 80.1.1º of the Regulation shall apply, following the general procedure.
