Importation of a vessel may be VAT-exempt if commercial or industrial use requirements are met

A customs agent asks whether importation of a recreational vessel registered for commercial use at sea may be VAT-exempt. The DGT states that exemption depends on the nature and economic use of the vessel as defined by law.

The question raised

Application of the exemption provided for in Article 22 of Law 37/1992 to the importation operation for Value Added Tax purposes.

The DGT's ruling

The importation of vessels may be exempt from VAT pursuant to Article 27.2 of Law 37/1992 if the requirements of Article 22 are met. The importer must prove the nature and use of the vessel for the activities justifying the exemption, retaining the authorized copy of the entry in the Registry of Vessels. Furthermore, a signed declaration determining the destination of the goods must be submitted to Customs.
