IRPF · exención por reinversión

Reinvestment exemption requires the property to have been a primary residence for the two years prior to sale

A married couple inquired whether they could apply the primary residence reinvestment exemption following a divorce, or if the exemption is lost if one spouse is no longer a tax resident. The Directorate General for Taxes (DGT) ruled that the exemption does not apply if more than two years have passed since the property served as a primary residence, or if the taxpayer is no longer a tax resident in Spain.

The question raised
