Contributions to a trust are treated as direct gifts to beneficiaries for Inheritance and Gift Tax purposes

A taxpayer inquired about the tax classification of contributing funds to an English trust to pay for her granddaughters' education. The Directorate General for Taxes (DGT) ruled that, as trusts are not recognised in Spain, the transaction is considered a direct gift from the grandmother to the granddaughters.

The DGT's ruling

Debido a la transparencia fiscal del trust, las relaciones entre aportantes y beneficiarios se consideran realizadas directamente entre ellos. La aportación de dinero y el nombramiento de beneficiarios constituye un hecho imponible por donación inter vivos. El impuesto se devenga en el momento de la aportación del dinero al trust. Si las beneficiarias son no residentes, solo tributarán en España si el dinero está situado en territorio español en el momento de la donación.
