10% reduced rate applies to Chapter 30 products if intended for direct use by the end consumer

A taxpayer queried the applicable tax rate for their diagnostic products. The DGT clarified that products under Chapter 30 of the Combined Nomenclature are subject to the 10% rate, provided they are for direct use by the end consumer and are neither medicines nor exempt.

The DGT's ruling

Para aplicar el tipo del 10% a productos de la categoría 30 de la Nomenclatura Combinada, deben cumplirse cuatro requisitos: estar en dicha categoría, no ser medicamentos, no estar exentos (como la sangre para fines médicos) y ser susceptibles de uso directo por el consumidor final. Si el producto no permite un uso directo, como los reactivos para determinar grupos sanguíneos sobre muestras, tributará al tipo general del 21%.
