Back pay is taxed in the year the court ruling becomes final

A worker sought guidance on how to tax back pay following the annulment of her dismissal and the deduction of unemployment benefits already received. The Directorate General of Taxes (DGT) ruled that this back pay must be attributed to the year the court ruling becomes final, and that any unduly received benefits must be excluded from previous tax returns.

The question raised

The DGT's ruling
