Non-EU pension schemes are not exempt from Wealth Tax

A tax resident in Spain has enquired whether the economic rights of a pension scheme (SIPP) are exempt from Wealth Tax. The DGT has ruled that the exemption only applies to schemes regulated within the EU or those falling under specific chapters of Spanish regulations.

The question raised

Tax treatment in Wealth Tax to be applied to the pension plan (SIPP). Specifically, whether the economic rights of the beneficiaries are exempt from this tax.

The DGT's ruling

The exemption of consolidated and economic rights of a pension plan only applies to those regulated in Chapters I to II of the TRLRPFP or in the second section of Chapter X (occupational funds in other EU Member States). Pension plans established in non-European Union Member States cannot benefit from this exemption, as its application would constitute a prohibited analogy.
