Inheritance Tax is settled in the Autonomous Community where the deceased had their habitual residence

A query was raised regarding which Autonomous Community has jurisdiction over Inheritance Tax following the death of an individual who had resided in both Madrid and the Canary Islands. The DGT ruled that jurisdiction lies with the Community of Madrid, as it was where the deceased maintained their habitual residence during the last five years.

The DGT's ruling

Las adquisiciones mortis causa tributan en la Comunidad Autónoma donde el causante tuviera su residencia habitual a la fecha del fallecimiento. La residencia habitual se determina por el lugar donde la persona haya permanecido durante el mayor número de días en el período de los cinco años inmediatos anteriores al devengo. En este caso, al haber residido más tiempo en Madrid que en Canarias en dicho periodo, la Comunidad de Madrid es la competente.
