Public remuneration of a consular employee in the US is taxable exclusively in Spain

A consular office employee in the US holding a 'green card' seeks clarification regarding their tax residence and the taxation of their salary. The DGT determines that, under the double taxation treaty, such remuneration can only be taxed in Spain.

The DGT's ruling

La residencia fiscal dependerá de si el consultante tiene presencia sustancial en EE. UU. o si su centro de intereses vitales está allí. No obstante, las remuneraciones pagadas por el Estado español por servicios prestados en una oficina consular solo pueden someterse a imposición en España. Al ser rentas obtenidas en territorio español por retribuciones públicas, tributarán por el IRNR mediante el modelo 210.
