Theatre teaching may be exempt from VAT depending on whether delivered as a professional or by an educational entity

An actor asks which VAT rate applies to theatre courses offered through associations. The DGT explains that exemption depends on whether the activity is carried out individually as a professional or through an enterprise.

The question raised

Value Added Tax rate applicable to the theater teaching activity provided.

The DGT's ruling

If the teaching is carried out by a natural person as a professional, it shall be exempt if the subjects are included in study plans and does not require registration in business activity tariffs. If carried out through a business organization, the exemption requires that it be an authorized entity and that the activity is not merely recreational. If these requirements are not met, the general rate of 21% shall apply.
