Requirements for the tax deduction for ascendants with disabilities: employment activity or receipt of benefits

A taxpayer inquired whether they could claim a deduction for their father-in-law with a disability in a joint tax return. The DGT ruled that a father-in-law does not qualify as an ascendant for the taxpayer and further noted that the spouse did not meet the requirements regarding employment activity or benefit receipt for the deduction.

The DGT's ruling

El suegro es un pariente por afinidad y no un ascendiente, por lo que el derecho al mínimo familiar corresponde a la esposa. Para aplicar la deducción por ascendiente con discapacidad del artículo 81 bis, es necesario realizar actividad por cuenta propia o ajena o percibir prestaciones de la Seguridad Social, desempleo o pensiones. Como la esposa no realiza actividad ni percibe dichas prestaciones, no tiene derecho a la deducción, sea la declaración individual o conjunta.
