Allocation of property within a joint ownership that persists in another asset is subject to transfer tax

The taxpayer seeks to be allocated a property through the dissolution of a co-ownership (extinción de condominio) while maintaining joint ownership over another property. The DGT rules that, as the joint ownership is not fully dissolved, the transaction is subject to tax as either an onerous or gratuitous transfer, depending on whether consideration is involved.

The DGT's ruling

La extinción de la comunidad debe ser total para tributar únicamente por actos jurídicos documentados. Si la comunidad persiste sobre otro bien, la operación se considera una transmisión de la cuota de participación de los demás comuneros al adjudicatario. Si hay contraprestación, tributa por transmisiones patrimoniales onerosas; si no la hay, tributa como donación en el Impuesto sobre Sucesiones y Donaciones.
