Wages for work performed abroad may be taxable in the country where the employment is exercised

A worker resident in Spain asks whether the countries where they carry out their activity can tax their salaries. The DGT explains that, under the Convention with France, the country where the employment is exercised may tax the remuneration, unless certain requirements regarding stay and the payer are met.

The DGT's ruling

Si el trabajador es residente fiscal en España, tributará por su renta mundial. Según el Convenio Hispano-Francés, los salarios pueden someterse a imposición en Francia si el empleo se ejerce allí. No obstante, solo tributarán en España si el trabajador permanece en Francia menos de 183 días en un periodo de 12 meses, la empresa no es residente francesa y las rentas no se soportan por un establecimiento permanente en dicho país.
