US investment interest may be taxed in both countries with a 10% cap in the US

A Spanish resident has requested a ruling regarding the application of the Double Taxation Convention with the US following an investment in a US entity that yields interest. The Directorate General for Taxes (DGT) has determined that these returns may be classified as interest and are subject to taxation in both States.

The DGT's ruling

Al ser residente en España, el consultante tributa por su renta mundial. Según el Convenio España-EE.UU., los intereses pueden someterse a imposición en el Estado de procedencia, pero el impuesto en EE.UU. no podrá exceder del 10% del importe bruto. España deberá eliminar la doble imposición mediante la deducción del impuesto efectivamente pagado en EE.UU., con los límites establecidos en el Convenio.
