Company payment of self-employed contributions treated as benefits in kind, affecting income tax withholding

A shareholder inquired whether the company's payment of their self-employed social security contributions (RETA) constitutes a benefit in kind. The Directorate General for Taxes (DGT) ruled that it does indeed constitute a benefit in kind and explained how it must be integrated into the calculation of Personal Income Tax (IRPF) withholding.

The DGT's ruling

Las cuotas del RETA pagadas por la sociedad al socio se califican como retribución del trabajo en especie. Para calcular el tipo de retención, estas cuotas deben sumarse a la cuantía total de las retribuciones y, posteriormente, minorar dicha cuantía según el artículo 83.3.b del RIRPF. El ingreso a cuenta se determinará aplicando el tipo de retención obtenido al importe de las cuotas pagadas por la entidad.
