Salaries paid to a cohabiting sister are deductible and subject to withholding tax

A lawyer inquires whether the salary of her sister, who lives with her and works in her firm, is deductible and if income tax withholdings must be applied. The Directorate General for Taxes (DGT) responds that the expense is deductible provided it meets the requirement of being correlated with income, and that such remuneration constitutes employment income subject to withholding.

The DGT's ruling

Los salarios de una hermana que convive con el empresario no tienen especialidad respecto a cualquier otra persona y son rendimientos del trabajo. Estos salarios son gastos deducibles si están vinculados a la actividad, se acreditan su existencia, cumplen el principio de correlación con los ingresos y se registran correctamente. Las retribuciones están sujetas a retención, salvo que se aplique el límite cuantitativo excluyente del Reglamento del IRPF.
