Pensions from collective insurance deemed income without 30% reduction

An insured enquires about the tax treatment of benefits from two collective life insurance policies covering pension commitments. The DGT rules that these benefits are deemed income from employment and are not subject to the 30% reduction applicable to other income types.

The DGT's ruling

Retirement benefits derived from collective insurance policies that implement pension commitments are considered income from employment, being included in the general tax base to the extent that they exceed the fiscally imputed contributions and the employee's contributions. As they are classified under Article 17.2.a) 5.ª of the LIRPF, they are excluded from the 30% reduction provided in Article 18. Furthermore, the transitional regime of the eleventh transitional provision does not apply because they were contracted after 2006.
