Tax residence in Spain depends on duration of stay, centre of economic interests or family unit

A self-employed architect working in several countries asks whether they should maintain tax residence in Spain or Bolivia. The DGT explains that residence is determined by staying for more than 183 days, the core of economic interests, or the residence of the family, and that in the event of a conflict, the Double Taxation Convention shall apply.

The DGT's ruling

La residencia fiscal se determina por la permanencia en España más de 183 días, por radicar en el país el núcleo principal de actividades o intereses económicos, o por la residencia habitual del cónyuge e hijos menores. Si concurren criterios de residencia en ambos Estados, el conflicto se resolverá según las reglas del Convenio de Doble Imposición aplicable, priorizando la vivienda permanente y el centro de intereses vitales. En ausencia de convenio con otros países, se aplicará la normativa interna española.
