10% reduced VAT rate applies to renovation works if material costs do not exceed 40% of the taxable base

A company sought clarification on whether installing a glazed viewing area in a dwelling should be taxed at 21% or 10%. The DGT explains that the 10% reduced rate may be applied provided that the requirements regarding the recipient and the age of the property are met, and that the cost of materials does not exceed 40% of the taxable base.

The DGT's ruling

Las obras de renovación y reparación en viviendas tributan al 10% si el destinatario es persona física para uso particular o una comunidad de propietarios, la vivienda tiene al menos dos años de antigüedad y el coste de los materiales aportados no supera el 40% de la base imponible. Para el cómputo del 40%, se deben incluir todos los materiales necesarios, incluidos los de subcontrataciones. Si el coste de los materiales supera dicho límite, la operación se califica como entrega de bienes y tributa al tipo general del 21%.
