Special practice agreement payments are deductible in income tax

The DGT confirms that payments under a special practice agreement are deductible expenses and are charged to the year in which they become due, according to the payment method chosen.

The question raised

Question posed: Whether the amounts paid to the General Social Security Treasury as a consequence of entering into a special internship agreement may be considered as a deductible expense in Personal Income Tax (IRPF), and in which fiscal year they must be allocated.

The DGT's ruling

Social Security contributions via special internship agreements are considered deductible expenses from gross employment income. Their temporal allocation must be made in the tax period in which they become due, which depends on the chosen payment system (single payment or installments). If a single payment is chosen, the entirety of the contributions shall be allocated to the year in which the agreement is signed and the payment becomes due.
