VAT, ITP and notary costs count towards reinvestment exemption

The consultant asks whether acquisition costs of a new home (VAT, ITP, notary, registration and legal fees) qualify for the reinvestment exemption. The DGT confirms that they do, provided they are included in the acquisition value under the LIRPF.

Cuestión planteada Si a efectos de la exención por reinversión, los siguientes gastos satisfechos para adquirir la nueva vivienda habitual pueden tener la consideración de importe reinvertido: IVA o ITP, notaría, registro y gestoría.

The DGT's ruling

Para la exención por reinversión, el importe a reinvertir incluye tanto el precio de la nueva vivienda como los gastos inherentes a su adquisición. Esto comprende el IVA o ITP, y los gastos de notaría, gestoría y registro, siempre que estos formen parte del valor de adquisición según el artículo 35 de la LIRPF. Dichos gastos deben haberse satisfecho en el plazo de dos años anteriores o posteriores a la transmisión de la vivienda habitual anterior.
