A one-off transaction does not constitute entrepreneurship or VAT liability

A private individual enquires about the tax treatment of a single €1,000 transaction. The DGT responds that if the activity is isolated and without continuity, it does not constitute entrepreneurship or entails VAT liability, although it must comply with IRPF based on total income.

The question raised

Taxation in IAE, VAT, and IRPF.

The DGT's ruling

For VAT, one does not hold the status of a taxable person if the transaction is occasional, isolated, and without intention of continuity, thereby falling outside the scope of the tax. Regarding the IAE, natural persons are exempt from the tax but must fulfill census obligations through form 036. Regarding IRPF, the obligation to file a tax return will depend on whether the sum of their total income exceeds the established legal limits.
