Special demerger regime cannot be applied if segregated assets do not constitute an autonomous line of business

A company that leases real estate and holds land for property development has enquired whether it can benefit from the special partial demerger regime. The DGT has ruled that, as the company lacks dedicated staff and a distinct organisational structure, the segregation of assets does not constitute a line of business and therefore does not qualify for the special regime.

The question raised

The DGT's ruling
