No obligation to file income tax return if capital losses are below 500 euros

A query was raised regarding whether incurring capital losses in 2021 mandates the filing of an income tax return. The Directorate General of Taxes (DGT) has ruled that there is no obligation to file if capital losses do not exceed 500 euros.

The question raised

It is asked whether the taxpayer is obliged to file the 2021 Personal Income Tax (IRPF) return due to the occurrence of the aforementioned losses.

The DGT's ruling

Pursuant to Article 96 of Law 35/2006, taxpayers who exclusively obtain income from employment, capital, or economic activities, as well as capital gains, with a combined limit of 1,000 euros and capital losses of an amount less than 500 euros, are not required to file a tax return. Therefore, if the capital losses do not exceed 500 euros, there is no obligation to file the tax return.
